Drinking and Driving Penalty Tiers in Pennsylvania

For adults, Pennsylvania law considers driving with a blood alcohol level at or above .08 to be standard DUI. There is also a tier of enhanced penalties for driving with a BAL of between .10 and .159, and an even higher penalty level for a BAL of .160 or above. The number of prior offenses also affects the severity of the penalties involved.

For example, a second misdemeanor DUI offense leads to a sentence of at least five days in jail and up to six months, plus a suspended driver’s license for 12 months, another year of using an ignition interlock device and $300 – $2,500 in fines. A third or subsequent offense carries more severe penalties, including a minimum of 10 days in jail and a maximum of two years behind bars.
